Terms of service

Booking, payment in US dollars, permits, drone flights, rescheduling, cancellation and delivery, under Mexican consumer law.

Who you are contracting with

These terms govern photography, video and drone sessions booked through this site in Mexico. The provider is TODO_LEGAL_NAME, TODO_ENTITY, RFC TODO_RFC, with its domicile at TODO_DOMICILE. Complaints and questions: TODO_EMAIL, TODO_PHONE. The Ley Federal de Protección al Consumidor (LFPC), article 76 Bis, requires these details to be given before any online transaction, which is why they come first.

Booking and payment

A session is confirmed when the retainer is received, not when the enquiry is answered. The retainer is TODO_RETAINER_PCT of the session fee and it holds the date. The balance is due TODO_PAYMENT_TERMS.

Prices shown on this site are starting prices in US dollars (USD) and exclude any permit, entry fee, venue charge or parking that a location imposes. Before you pay anything, the total amount payable — including taxes, commissions and every pass-through charge — is confirmed to you in writing, as LFPC article 7 Bis requires. TODO_IVA.

A US-dollar amount payable in Mexico may be settled in Mexican pesos at the exchange rate in force at the place and on the date of payment, under article 8 of the Ley Monetaria de los Estados Unidos Mexicanos. TODO_MXN_DISPLAY.

Permits, entry fees and venue charges

Some locations charge for professional photography or filming, or require written permission: archaeological zones administered by the Instituto Nacional de Antropología e Historia (INAH), protected natural areas administered by the Comisión Nacional de Áreas Naturales Protegidas (CONANP), municipal beaches and plazas, and private venues. Hotels and resorts frequently charge an outside-vendor fee for a photographer who is not on their staff.

These charges are your cost. Each one that applies to your session is named, with its amount where the issuing body publishes one, before you book, and appears on the invoice as a pass-through. A permit is decided by the authority or venue that issues it, not by us; where one is refused, an alternative location or date is offered at no extra charge.

Drone flights

Drone work is flown under the rules of the Agencia Federal de Aviación Civil (AFAC), including NOM-107-SCT3-2019 on remotely piloted aircraft, and under any restriction set by the site — protected areas, archaeological zones, airports and hotels each set their own.

A drone flight depends on that authorisation and on conditions on the day. The pilot may cancel or cut short a flight for wind, rain, airspace restrictions, an instruction from an authority or venue, or the safety of people on the ground, and doing so is not a breach of these terms. Ground photography or video booked alongside continues as planned. TODO_DRONE_TERMS.

Rescheduling and weather

You may move a session once at no charge with at least seven days' notice. Inside seven days, the retainer is forfeit and a new one is due.

Weather is not a cancellation in itself. Overcast skies and light rain are working conditions and often better ones. Where conditions make the planned location genuinely unusable — lightning, a hurricane or tropical storm warning, a closed site or beach — the session is moved rather than cancelled, at no charge, at whichever party calls it.

Cancellation

Your statutory right to revoke

Under LFPC articles 51 and 56, a service contracted outside the provider's premises — which includes a booking made through this site — becomes final five business days after you sign or accept it. During those five business days you may revoke your acceptance without any liability, and every payment is returned. The right does not apply where the session date is ten business days or less from the date of your order. Notice of revocation goes to TODO_EMAIL, and this right applies regardless of the table below.

Delivery

A private online gallery is delivered within the window quoted for the service, counted from the session, not from final payment. Weddings and multi-day work carry their own quoted window.

The number of edited photographs quoted for each service is a minimum, not a cap. Editing means colour, exposure, contrast and blemish work in the photographer's own style. Composite work, body reshaping and the removal of people or permanent objects are not included and are quoted separately if wanted at all.

Galleries stay available for twelve months. Download your files: archival storage beyond twelve months is not promised.

What is not promised

Photography is a craft and not a guaranteed outcome. What is promised is a professional who arrives on time, works the agreed hours, and delivers the agreed number of edited photographs at professional standard. What cannot be promised is that a particular person will smile, that a venue will permit a particular frame, or that the light on a given evening will be the light in the portfolio.

Where a photographer cannot attend through illness or emergency, a replacement of equivalent standard is arranged where possible; where it is not, every payment is refunded in full.

Nothing in these terms limits a right or a remedy that the LFPC gives you, or excludes liability that Mexican law does not allow to be excluded. TODO_LIABILITY.

Your conduct on a shoot

You are responsible for securing permission to photograph on private property that you arrange, for the behaviour of your own guests, and for telling us in advance about anything that affects safety. A photographer may end a session where they are subjected to abuse, threats or an unsafe location.

Complaints and the consumer authority

Write to TODO_EMAIL first; a complaint is acknowledged in writing. The Procuraduría Federal del Consumidor (PROFECO) is the federal consumer authority in Mexico and receives consumer complaints against providers (gob.mx/profeco). Using PROFECO does not require you to have complained to us first.

Governing law and jurisdiction

These terms are governed by the federal laws of the United Mexican States, the LFPC among them. For anything PROFECO does not resolve, the competent courts are those of TODO_JURISDICTION. Your consumer rights under the LFPC cannot be waived (article 1), and no clause here submits you to a foreign court (article 90).

Language

These terms are published in Spanish and English. The Spanish version prevails, as LFPC article 85 requires for a contract made in Mexico.

Changes

These terms may change for future bookings. The version that governs your booking is the version published on the day you paid the retainer, and a copy is sent with the confirmation for that reason.
